Absolutely, he is in the wrong.
But nobody died (yes, could have, but didn't..)
Fine him, take his license for few years, never allow him to drive large vehicles, get him some Public work to do, but don't send the man to jail... What is that going to achieve? Because of that, he will never ever get a proper job in the future..
He didn't kill anybody, didn't steal anything.. Punish him for his lack of awareness, but not by sending him to fn jail...
