As previously announced, the US Patent & Trademark Office
(USPTO) accepted a request from Cisco (during the first round of Stat Mux litigation) for a re-examination of the Stat Mux patent. The USPTO has just handed down an office action which is unfavourable in respect of the claims of the Stat Mux patent which the defendants in the Stat Mux II proceedings are alleged to infringe. ipernica is currently preparing an appropriate response to the USPTO, which will be filed by the deadline of 4 November 2008. Further updates will be provided in due course.
