The arbitration is not looking at the right of FAR to PE as such.
It is looking at technical compliance with JOA terms of COP's notice to the JV participants of the change of control of COP Senegal B.V and the partners subsequent rights to PE the 35% of SNE. FARs dispute claims that the notice COP issued to them did not fully comply with the terms of the JOA.
The Tribunal will rule on the notice compliance and consider the remedy options and the requested remedy from FAR if they agree with the claim.
