I have not read anything anywhere where Lynas stated they did this to cause SMSL to spend funds. That is sheer conjecture on Tototy's part. Ask yourself if Lynas should tell us something like this. Even if they did have that reason they wouldn't tell us.
My speculation is that there is something that indicates the time for appeal can be waved, possibly by the judiciary. So rather than object, they decided to get it out of the way, betting that what has happened would not happen. Otherwise it could happen in the middle of start up.
Also, I have not seen Tototy's source, as he never posted a link. I'm sure there is some basis in truth, but he might have misinterpreted something, he has done that before.
