I don't think it takes a legal eagle to answer this question...
There is no logical way that kynas could have repaid the debt if the option existed for payment in full to be demanded... It would. Have been financial suicide... Think about it.
When mt Kellett became involved, the situation was such that income to kynas was never going to be happening by July.... It could never be repaid with cash... So it was always going to be a share dilution...
Happy to be corrected, but NC would find himself in hot water if he agreed to repayment prior to income stream..
I don't think it takes a legal eagle to answer this...
