Not exactly sure what your basis is for a law suit. The new board would simply say, upon gaining access to all information this is what we found.

Simply put the trial missed its primary endpoint and it was not a small trial. The drug failed. End of story. More than 90% of drugs that enter clinical trials fail to get to market. XToll is just one of that 90%. And then people say, but board and management said....... Well all boards and management say those things. If they didn't believe in a drug, they either shouldn't be with the company or they should kill the project.
