There is a concept of reasonable expectation eg a publican can be held responsible for the actions of someone who has been allowed to become obviously over intoxicated in his establishment ..... he has a duty of care to not abet harm that may be occasioned by a drinker's excessive intoxication & he has reasonable expectation that excessive consumption is likely to increase the risk of harm happening.
Surely it is the same with the lending of script to a short seller. Opes Prime would certainly know that the script would be sold agressively in order to push the sp lower, a direct contradiction to the desires of the owners of the script.
