As far as I know, nobody has binding legal permission to grow in NSW yet because NSW hasn't even been granted the permit it recently applied for from federal. I understand that this and the Vic govt's test crop have been allowed to proceed simply because there's no impetus on anyone to prosecute and a good chance that any such case would be thrown out of court, given the common intention to develop the industry and lack of any real resistance to changing laws. It's telling that Victoria is keeping secret the location of its crop; there are still potential legal jobstoppers that could scuttle their work (if anyone decided to persue it).
