Hi Whisky. I'm still not sure that CAP would even have the right to chase FAR for money. As you say the agreement is with the majority holder and operator CAP.
I have a couple of question though for anyone who cares to have a shot.
If FAR had to the 31 October 2016 to farm in and didn't, doesn't that mean that CAP/Trace can look elsewhere?
Secondly, does anyone know for a fact that FAR had to hand the 3D over if they decided not to farm in? Or was it only to be handed over in the event of a farm in?
If I was paying for 3D and decided not to farm in I would tell them to po....it was our money and a swap for a farm in option. DB
