I'm not sure what you're getting at Colt and how the examples you provide are similar to FAR.
I haven't read every post. Those making comment on an objective level have said FAR needs to refute the court case. FAR can bag the publisher along with the rejection, until this is released by FAR there's zero to defense.
By the way this is the tactic most of the best managed companies deal with issues like this. It's not N unreasonable request.
