    I was in the same predicament as you a few years back. I too had to set up a separate entity for trades while personal shares transactions are all considered capital gains/losses. I got the advice from my accountant. Like you, I can't find anywhere on the ATO where it says one can be both. Only how one can be considered a trader or an investor.

    Anyway, I have since done away with my trading activity. Just not good at it. I can still do 'short term' investing when the opportunity arise. Less complication that way
