The way I read it, in these administrative cases it is not A v B, but A as plaintiff looking for a Federal Court ruling that no wrong was committed - there is no respondent (ASX or ASIC).
In this case, TV2 making application for orders to remedy the situation, ASIC and ASX have been invited to be party to the proceedings in order that the matter can be robustly explored. It is not TV2 v ASX.
Given the case/s precedent I would imagine it to be a better process than just TV2 arguing it, so to lessen the chance the judgement could be challenged in any way.
It is annoying and should not have happened, but it is not the end, and I doubt it will affect any deals. These things happen.
