If you had then you wouldn't be making the claim "...we have a great upper hand and will most likely win the court case."
If it had gone Judge Chetwynd's way in Feb 2012, Axiom would have lost right there and then. The only reason Axiom didn't loose, and this is now going to be sorted in the High Court, is because of a small technicality called "land banking".
No one knows how this court case is going to turn out, how much weight the judges really put on the whole land banking issue. It's not even sure if Axiom is going to get the mining permit even if they rule against SMM based on the land banking issue. The land could be re-tendered etc. This whole thing is in the judges hands, and the outcome is unknown.
Now don't read too much in between my lines; I am not hoping that Axiom looses! Most of us have shares in this company, so a loss doesn't benefit anyone of us!
