I agree with what you saying but the two aren't mutually exclusive. A satisfactory outcome via mediation is possible. It is possible to mediate, and elect to proceed with the case if mediation doesn't deliver anything that the company considers acceptable. It is dangerous to reject mediation if it is offered.
