It’s worth doing some research Emu before posting propaganda from the previous corrupt Ghanaian Government.
There is a false narrative circulating regarding the ongoing international arbitration case between Cassius Mining and the Ghanaian government. The previous Ghanaian government claimed that because the arbitration tribunal has designated Ghana as the seat of arbitration, the Ghanaian courts can prevent Ghana from paying any potential award. This is misleading and ignores the fundamentals of international arbitration enforcement. While the seat of arbitration is in Ghana, it does not give the local courts the power to override a final ruling by an international tribunal. International arbitration awards are recognized and enforceable under the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, which Ghana is a signatory to.If Ghana refuses to comply with an arbitration ruling, Cassius Mining can seek enforcement in jurisdictions where Ghana holds assets. Courts in other countries are not bound by Ghana’s legal system when it comes to enforcing an international arbitration award. Even if Ghanaian courts attempt to annul an unfavorable ruling, the award can still be enforced elsewhere, potentially leading to asset seizures. The notion that Ghanaian courts have the final say in this arbitration is false. International arbitration exists precisely to prevent local legal systems from undermining fair rulings. If the tribunal rules in favor of Cassius, Ghana will not be able to simply disregard the decision without facing significant consequences in other jurisdictions. As this dispute unfolds, it’s important to separate fact from fiction. International arbitration rulings stand—and Ghana’s domestic courts cannot change that reality.
