If the JOA has been compromised how can Senegal approve WPL as a JV partner. The JOA is a major deliverable, requiring approval by all parties and compliance by all signatories.
In the early days FAR requested Senegal to intervene and they distanced themselves, requesting the parties to sort it out amicably. FAR then proceeded into arbitration when that failed and Senegal were notified. If arbitration then falls in favour of FAR, Senegal would have to then intervene, or be open to international attention and criticism by the opposition as being complicit in fowl play. Life would remain very uncomfortable for Senegal, it would test of their open and honest policy and the press would also jump all over it.
Yes, I do not think we need to worry about further legal proceedings after arbitration if the JOA has been compromised. COP will have been exposed as not playing by the agreed rules pertaining to the development of a foreign country’s resources. The pressure of that will in itself expedite a resolution.
