As I understand the 45 day rule, the key is to identify the shares you are selling into the buyback are ones that you have had for a longer timeframe, in my case years in fact. Buying at the same time around the buyback is not problematic, and particularly if you are buying variable quantities that are not associated with the quantity you sell
in any event, get accounting advice if in doubt
