I sold my cba shares on the ex dividend date and i will take up the offer of the $10,000. I don't hold any shares at the moment, however i held them when it went ex-entitlement and therefore can participate in the spp.
I dont think the washing rule will apply if you were to sell now and buy in the spp at a cheaper price.
The washing rule tries to stop tax evasion by saying you cannot sell a share and buy the share back in order to get the tax deduction.
The tax deduction is not the main reason here for the sale (you are selling to participate in the spp)and therefore i dont think it constitutes washing IMO.
