They have used legal recourse before and I expect their legal team to be fully engaged strategically.
But there is always the pragmatic question how to best advance.
Diplomacy is always the best first approach on the issues. Because if you humiliate on every point you set yourself up for animosity and the FDA are the decision-maker.
Which is why SI takes a collegial approach and actively uses the term.
I'd say legal recourse is more like the visible background option, as Teddy Roosevelt said:
speak softly but carry a big stick.
