I would not rely at all on the ICC's 'set timelines' that 'must' be adhered to.
See below for an extensive list of ICC arbitration cases that had their terms of reference set way back in Feb-March 2017 that are still pending.
What we know from Bullant's understanding is that the panel 'should' be constituted by the end of the month, given the panel hasn't been constituted that means the Terms of Reference haven't been set yet for FAR's case. The cases listed below are at least 12 months further advanced than FAR's case. God knows how long it will take for the Terms of Reference to be set given they couldn't even agree on an independent chair.
Sorry to sound like a broken record on this, but the constant talk of twelve months from filing is not supported by facts.
