It is important to note that the accellerated procedure (added in March 2017) doesn't apply to cases over $2M or when arbitration agreements were created prior to March 2017 - the constitution of the tribunal would have had a time-limit if the accellerateed provisions applied and this saga would already be over. I dont think there is any time limit to constitute the arbitration tribunal under the applicable rules but there are emergency steps that can be taken if FAR desperately needed money.

There is a provision in the rules where a party can request emergency Arbitrator to fast track constitution of the tribunal. It would be interesting to know DB if you still have the document to hand the date of the JOA (which includes arbitration agreement). Is it dated prior to Jan 2012?



IMO all delay works in FAR favour and they would not need to pull this trigger.
