its still a punt, but i think the chances have improved greatly now that the federal court dismissed the ACCC's appeal over the Metcash/franklins deal.

the issues seem to be similar in this deal

indeed the head of the accc said himself that the outcome of the metcash appeal would have serious implications for their ability to block mergers in the future.

also lawyers are saying that the decision increases the burden of proof for the accc to prove what would happen if the merger does not proceed, from a 'real chance' to higher 'balance of probabilities' standard as in civil cases.
