The court case wasn't regarding that. it ends in 2020 and only lasts longer if they build a plant (which they can't afford to do and their lepolite hill resource turned out to be a dud so they have nothing to out in it). Also they have their own superior tech (it's gone no where in years and that's what the court case was about, them tryinf to rip off lmax... allegedly) don't recall any public SDV results but the bench and pilot have tested concentrate from many different continents all with great success.
