There are orders from the Arbitral Panel relating to what can be disclosed about the proceedings. The Thai Government applied for a suppression order which was resisted by KCN unsuccessfully. The custom when attempting to settle a proceeding is that such negotiations are confidential. An NDA stands for a non-disclosure agreement which is a confidentiality agreement, which is often entered into when mediating.
