From my understanding, once you file for an extension for your intent to defend and it is granted and then still do not file a motion to defend and do not ask for any further extensions, you waive your right to defend as there is a statue of limitations. But I am by far from a legal expert. I also thought that they had to announce news like this as it does affect SP and there has to be transparency, but again I am not a legal expert.
