It's very hard to say. PAM do have a point regarding the differing structures for taking over a company.
But the courts can be funny and not take a logical view of things so it'll just be a case of wait and see what material is put out by the respective groups in relation to the take over attempt. ie MIM, Xstrata, Vince Gauchi & PAM.
Personally I am inclined to vote against the scheme of arrangement as I prefer to look longer term than a month or two. I tend to buy and hold stocks for 5 to 10 years, sometimes taking some profits by selling a portion of my holdings. This process has paid off nicely for me with a number of my shareholdings, ie BPC, SHV, TAH, WOW.
Demand for copper should increase with the rebuilding of Iraq, with the rise of the Aussie dollar the negative impact of MIM's currency hedging is becoming neglible, in fact some of their positions must be close to being positive by now.
