Take2, I have just heard from the company that the motion you refer to, specifically relates a request by CHM for the documentation as per the announcement by MMX on the 17th of December 2007, which MMX refused to release. These and other matters are all to be heard on the 20th of March, as per the ajournment notice everyone has been referring to.
This does not relate to the court order for MMX to file their defence by the 22nd, which they are now in breach of.
For a company that is stating they have the relevant documentation which justifies a conclusion of no substance to the CHM claim, and pubically state "We will be instructing our lawyers to bring this matter before the court as quickly as possible", why are they now contraviening a court order, which puts their credibility in question?
Just an observer. I hold no stock in CHM or MMX.
