There are cases where titles to properties have been stolen and used for loans or sold outright - such as a physical (original) house title being stolen.
In these cases the title is all significant and not the original intentions of the rightful owner.
In MMX case, they have title and purchased in all good faith. Possession rules. Even better, sale was around time of original CHM insolvency. CHM would have to wind back the clock and go through government departments, all sorts.
This might be a fun exercise for lawyers who can't lose - anything they do in this case is a free advert for their services - but for CHM it means they are putting their company on the line in an all-or-nothing take down with odds stacked against.
