MMX did not raise any money in mid 2004.
It had 30k in the bank and was suspended for not paying its listing fee's.
When it re-emerged all details were supposedly set out in prospectus and supp.
What was not explained was where the extra 400k in the bank came from and how Winterfall paid the 500k in deposits to the IO vendors.
I think you may find the whole forensic accountant defence went by the wayside for MMX.
It seems from your arguements MMX defence is we are an innocent in all of this. CHM arguement is that MMX were up to their eyeballs in all of this.
Who do you think was running MMX through 2004 ?
For MMX not to be for a large loss it must demonstrate that its executive knew nothing and also did not just turn a blind eye as it didnt want to know where the money came from.
