It appears CHM believe they had an early termination clause and the funder doesnt. Sage and CFE obviously agree with CHM.
If Sage is correct then MMX have offered settlement amount and I guess funder wants to settle and lock in a profit and CHM want to take the case through to the end.
Not a good look for the funder if this is the case as who would want to use a litegation funder that pulls the rug out from underneath you this close to the end of a case.
Short term gain but wrecks your whole business in Australia as no one else would use them ever again.
MMX will be desperately hoping funder has a win.
