My understanding is they still have another 7 months to sort out the PDF, so if the government backflips on this, then is Lynas in a position to sue the government? If they're operational mid Jan and can demonstrate all the extra stuff (waste, residue, REE afterbirth call it what you want :) can be converted to road-base or diluted to less than 1bq/gram then they no longer need the PDF.
