It may be if he cant produce the evidence and methodology that they used calculate the numbers down to sales rep/ hospital.
Being wrong is not a crime, thats just a measure of competence. But saying you have done something doesnt make it true.
To sprout these numbers during a cap raise and miss by so much is suspicious.
This is the grey area that would be interesting to see pursued
