Those thoughts are completely incorrect.
Disclaimers in an IPO prospectus cover people buying from the IPO not on market afterwards. Do you read BHP's prospectus if buying BHP shares, of course you don't it would be pointless. If management wanted shareholders to know this important information they should have included it in all their market releases but they didn't.
ASIC and ASX rules trump a small disclaimer an ipo document.
