And that's why the class action will fail. You can't sue on the premise by chance you may have made more profit. To be successful you have to prove loss. Now if you sold out at a loss that may not be enough. You would have to show that if you were still holding now, you have made a loss. Perhaps at a stretch, if you could have made a profit by selling when the SP was at a high that may also be sufficient for the action to fail. I don't think WBC will settle, unless it was for a small amount.
