They would simply argue that the comments made at that time, were based on the actions and information at the time.
Contracts not coming to fruition isn’t cause for a class action.
Class action will only prove fruitful when there is evidence of deceptive and unconscionable conduct.
Telling you to invest because the contracts are in the bag, knowing full well they weren’t, would be an example.
There is cause for sticking it to the board though.
