But breaches of continuous disclosure obligations remain the most common cause of class actions.
The most recent example of this is OZ Minerals, which now faces a class action by IMF on behalf of shareholders, alleging misleading and deceptive conduct and breaches of continuous disclosure requirements over its debt position. OZ denies the allegations.
As a sign of just how angry shareholders in OZ Minerals are, at least 500 investors have so far contacted IMF to join a class action. ( source todays AUSTRALIAN) . The 500 may not be true, but it still looks like the C/A will be going ahead. The time for not rocking the boat has long gone, some one has to fall on his sword. AM gambled on zink prices,didnt hedge and lost. If it was a football side he would of been sacked months ago. I dont want a class action, but I dont want a wooden spoon either..
