Yeah, the problem here is that management have played their cards. They have admitted to everyone that they can't make this work by themselves and that all the announcements about dual listing and Halucenex were essentially empty promises. Accordingly, if the merger fails, the company will likely self-implode due to a profound lack of confidence in the board. What a shambles.
