Surprising result after the FBI Director said they discovered top secret emails sent to and from her private server. Bit cheeky and putting pressure on DOJ by saying 'no reasonable prosecutor' would lay charges.
Prosecutors don't appreciate the investigators stepping on their toes in that fashion. Would have been more appropriate to say 'no reasonable investigator would recommend charges', since that is the extent of their role, whether or not true.
Interesting that he characterised the need for there to be some sort of ill-will or 'intent' to be present to justify charges. Bit of a stretch to claim that in other cases large quantities allowed for such an inference to be drawn, but not for the low number of top-secret messages in Hilary's case.
Must have a look at the relevant provisions because I assumed that the proofs of such offences would not include 'intent' at all, since the protection of classified material seeks to prevent 'loose lips sinking ships', not merely punish those mishandling such material with deliberate 'malice'.
