Refugees can apply for asylum where ever they want. This has been well established in court, many refugees have had their status upheld by the high court after passing through Indonesia.
It is also not up to Australia to define who is a refugee. The definition is within the UN convention. It includes for instance anyone who considers themself homosexual from a moslem country.
