Pity BI is already in the market with first mover advantage.

Doesn't matter what the contract says, if you don't sell any of your product because the competition got there first you don't get any of the commissions, royalties or any other cut.

And what's ACL doing about? They are waiting.

And why?

Because they decided to abdicate control of the product to a third party.

I'll wait for the buyout. If they adopt this strategy with the first drug they will adopt with every drug thereafter. Thus with such logic they are better off just to sell off the actual goose.
