Actually SAMR is administered by SAIC OR SAMR
http://samr.saic.gov.cn/ which gives the permission of IF to be sold in Brick and Morta. Customs only check If the IF being imported is manufactured by recognised producers. IF without SAMR can still be imported and can only be sold online, not in physical stores.
