They only have to give notice ie; 30 days if they intend to apply...How ever the Government can invite AVQ at any time....the only reason i can suggest for them not inviting or AVQ not applying is to not allow any further disruption by SMM to the current court proceedings .and to save any costs or work that would be associated with that , even if AVQ have a right to apply SMM could find a right to object just to debate it in a court which would further procrastinate the appeal.....just an opinion . cheers
