Surely the agreement with APA contains a non performance clause (and impact to each party of any failure) and a termination option.
APA had one job to deliver a processing plant. A failure / delay should come with compensating damages to the other party.
This is a commercial venture, not some playground agreement.
How much longer are we supposed to wait and allow APA off the hook after they failed to deliver the processing plant which is now of financial consequence to COE shareholders.
