You are putting to much of your lack of knowledge about the development of products and an understanding of continuous improvement. No one has a crystal ball so at times you have to P with the C you got. If the government done nothing there are some who would still complain and argue, that at least they should have tried. The Federal Gov. did nothing and there are those that have rightly complained. The health advisers and the States stepped up and had a go, and full credit to them for the effort that they applied.
