WUC's effort to determine whether ablation will need to be licensed by the NRC and Agreement States has finally begun. For the next several months, the Colorado Department of Public Health & Environment will take comments from the public and will decide whether ablation must be regulated under the Atomic Energy Act of 1954, U.S. Nuclear Regulatory Commission regulations, and State of Colorado radiation control statutes and regulations.
WUC's position is that ablation is "mining" and therefore outside the scope of such regulatory authority.
