However there was no disclosure as to the cause of the dam failure to shareholders for a full 6 months after the event occurred. The timing of the disclosure was not until the resolutions had been passed to re-finance the operation.
Continuous disclosure is a requirement of ASX listed companies. It is possible that disclosure to shareholders of the dam failure may not have occurred without the overwhelming evidence gathered; 43 avadavat statements plus satellite images leading up to the event.
