Given the effort and (who knows how much) cash they have put into their fight, as well as the record nickel prices, I'd imagine they will be interested in recouping money quite quickly if they win.
Current prices of Nickel would give them some incentive to get the ball rolling.
It's an interesting point you make Deet, I don't remember the actual reference that explicitly states SMM will land bank the dispute area, but it has certainly been a featured reason on HC as to why AVQ should win the case. Some suggesting it is a factor the judge will consider and stating the locals need AVQ to win for their prosperity, as SMM have no plans to mine there for quite a while. I don't remember anyone calling for the reference in that context.
