Let's not forget that even if SMM win their case against the SIG, the LOI does not automatically give them the right to prospect or mine the resource, that is up to the Land Owners, nobody else.
SMM would still have to negotiate with the Land Owners, a failure to reach an agreement would result in the Resource either being put up for option A, re-tender or option B, granted to the Land Owners preferred partner Axiom KB.
So presuming SMM win back the LOI how long do they have to reach an agreement with the Land Owners, or more importantly if the Land Owners tell the Government that they will under no circumstances negotiate with SMM is the SIG now able to cancel the LOI stating their reasoning as irrecoverable discordance or dissension from the Land Owners.
