The problem lies if the agent has said I will get you this price and fails to do so,you go somewhere who tell you closer to the truth,the first bloke want a piece of the cake which he said he would get a better price to get the job,Who is right ,Who is wrong,I would hate top rely on Judges for anything as most live in a different world where money is values more than rights or wrongs.
