Arbitration was a Hail Mary for ETM. The Mineral Resources Act provided the company with legal recourse against the GoG decision to reject their mining license application.
ETM have now appealed the GoG decision, which should have been done in the first instance. If the appeal was unsuccessful, arbitration might have been an option.
Doubt the arbitrators are going to make a decision a case that is now before the Greenland courts. Which is why the GoG is claiming arbitration has no jurisdiction in the first instance.
Bifurcation is a given IMHO.
